GENERAL TERMS AND CONDITIONS OF THE MISE SUR TOI SITE

WHEREAS Mise sur toi (hereinafter referred to as the “Organization”) maintains a website (hereinafter referred to as the “Site”) in the interest of offering all persons free access to information on responsible gambling. This information is available at the URL address misesurtoi.ca (hereinafter referred to as the “Domain Name”);  

WHEREAS people who access the Site (hereinafter referred to as the “Visitor(s)”) do so of their own accord;

THE VISITOR ACCEPTS THAT these “General Terms and Conditions” govern the contents and operation of the Site in addition to the Visitor’s authorized use of the Site’s contents and operation. The Organization agrees to respect its Policy Concerning Privacy and the Protection of Personal Information regarding the Visitor.

1. INFORMATION ACCURACY

Although great effort has been put into the development of the site, the Organization gives no guarantee, express or implicit, of the accuracy, completeness, validity or current status of the information provided. The Organization reserves the right to modify or update, in whole or in part, the Site’s contents, at its discretion and without notice.

2. EXCLUSIONS OF LIABILITY

The Organization offers no guarantee to the Site’s use. Visitors agree to use the site as-is and to trust the site at their own risk.
The Organization and its board of directors, employees and agents are under no circumstance civilly or otherwise responsible for any loss or damage of any nature, including but not limited to a loss of earnings, an interruption of activities, the loss of programs or data that may result from, among other causes:

(i) the use of the site or any site related by hyperlink or otherwise to the Site,
(ii) the modification or removal of all or part of the Site, including a hyperlink, (iii) errors, omissions, inaccurate or outdated information found on the Site or received by the Visitor following an information request submitted on the Site,
(iv) any instance of harmful programming that may be installed on the Site or that is transmitted through the Site’s use.

3. INTELLECTUAL PROPERTY

Certain names, words, titles, expressions, logos, icons, graphic elements, drawings and other content on the Site’s pages constitute elements of intellectual property belonging to the Organization. All material contained on the Site is protected by copyright.

All unauthorized download, retransmission, copy or modification of trademarks, images, texts or data contained on the Site may contravene federal or provincial laws—especially those pertaining to trademark, industrial design or copyright—and may subject the Visitor to legal proceedings.  

Except for the purposes of navigating the Internet, or unless otherwise indicated, it is strictly prohibited to copy, redistribute, reproduce, republish, store on any medium, retransmit or modify the information contained on the Site, or to make public or commercial use thereof in any way whatsoever.

4. DOMAIN NAME

The Domain Name is the exclusive property of the Organization and may not be appropriated or infringed upon by way of hyperlinks or framing. Similarly, the registration of closely similar domain names will not be tolerated.

5. HYPERLINKS LINKED TO FROM THE SITE

The Site contains links that enable the Visitor to access sites operated by third parties. These links are given for Visitors’ personal use and are there to provide them with a more intuitive and pleasant browsing experience. The existence of such a link in no way implies support, implicit or explicit, of the site to which it links, that site’s contents or the sites that are linked to it. The Organization can in no way be held responsible for the contents of links.

The Organization is at all times free to add, remove or modify any link appearing on the Site. The Organization does not assume any responsibility for the choice of the links provided.

6. HYPERLINKS LINKING TO THE SITE

The Organization expressly prohibits any person from authorizing or establishing a link to the Site from a third-party site, or from using any framing, mirror site or other similar method without the Organization’s prior consent.

The presence of unauthorized links on third-party sites in no way indicates consent or renunciation of the Organization’s rights or recourse. The existence of any unauthorized link to the Site does not commit the Organization to any responsibility.

The Organization’s authorization in no way supports, sanctions or otherwise recognizes the contents of sites on which a link to the Site exists. The Organization is in no way responsible for the contents of sites linking to the Site or for any link contained on those sites.

7. LANGUAGE

In the event of a discrepancy between the English and French versions of the General Terms and Conditions page of the Site or between French and English versions of the Policy Concerning Privacy and the Protection of Personal Information, the French version shall prevail.

8. SPECIFIC CONDITION

In the event of a discrepancy between one of the conditions indicated in the General Terms and Conditions and a specific condition indicated on a page of the Site related to specific content, the specific condition shall prevail.

9. JURISDICTION

If the Visitor’s use of the Site should result in any conflict, such conflict must be resolved accordance with the laws applicable in Quebec and in Canada before a Montréal judicial district court.

For the General Terms and Conditions and the Policy Concerning Privacy and the Protection of Personal Information, the “Visitor” is defined as an individual who navigates the Site and who authorizes the use of the computer or other navigation equipment.
